www.acrtech.com: It is a website (“Site”) where corporate information belonging to Acrtech Bilişim Ltd. Şti. (“Acrtech”) is presented. Please read the following terms. Your access to the Site is subject to the legal terms written below determined between you and Acrtech.

General Terms of Use

From the moment you start using the Site, you gain the right to access, use, and receive commercial communication, commercial electronic messages, certain interfaces, and functions offered through this Site or via this Site and, if any, other related sites.

Entering this site and using the site means that you have read and accepted the usage policy and terms. For this, your "statement of acceptance" received or created in any form is not sought.
In cases where you become a member or your explicit declaration of acceptance is required, you are deemed to have accepted the terms of use written here by selecting the "accept and confirm" steps.

User Content

Responsibility for transactions and actions related to any information, written text, opinion, visual, photograph, link, and similar content (“User Content”) sent or disclosed, entered to the site by the user (including liability to compensate for damages suffered by Acrtech and third parties) belongs exclusively to the user. Acrtech reserves the right, without obligation in this direction, to pre-screen, review, remove completely or partially from the scope or publication, or block access to this content placed or sent to the site by users.
The user accepts and undertakes not to generate income through the User Content they will add and not to engage in commercial activities.
It is accepted that the confidentiality nature of any User Content sent, transmitted, used, created on the site or transmitted to third parties through the Site by users is eliminated and does not contain any intellectual and industrial right/copyright/license right. When users create any content that is thought to be confidential or has intellectual and industrial property rights and add it to their account, it is accepted that this content does not contain a "legal defect" and they have the right to publish them via digital transmission. The user has accepted that the User Content they have uploaded to the site or shared in any way can be used by Acrtech and/or other users in a way that includes/contains promotion, logo, or similar content to be determined by Acrtech and without carrying any explanation or sign regarding ownership or disclosure; can be shared with third parties or uploaded to other websites, linked; can be viewed by third parties without membership requirement. Acrtech may subject User Content to trade and generate income on them in any way. The user has accepted and declared that they give unconditional permission for the use of User Content by Acrtech.

No Warranty

This site is offered for the benefit of users as is and does not contain any written or oral, special or general warranty to the widest extent permitted by law. Acrtech does not guarantee that the functions and content on this site are secure and error-free, that defects will be corrected, or that the site itself or sub and super sites/links belonging to 3rd parties, together with the server used to offer this site, do not carry viruses or other harmful content.

Acrtech does not give an explicit or implied commitment that the site and the provided content will meet all expectations, purposes, and special needs, and will be uninterrupted and of sufficient quality. Acrtech assumes no responsibility towards members or Users for consequential damages, resultant damages, or indirect damages such as loss of profit due to the site or site Content. Acrtech reserves the right to partially or completely terminate the site publication, close it, partially or completely change all content, visual design, and similar elements on the site, disable them, or make them paid without prior notice.

Sub and Super Links

On this site, there may be sub and super sites operated by 3rd parties that Acrtech does not own and does not control the operation of, and links may be provided, links/information may be given to them. Acrtech has no guarantee or special commitment regarding the content, suitability, security, privacy policies, and continuous communication of these accessed sites. Acrtech cannot be held responsible for the personal data provided to the said sites, the content and services utilized from these sites, and the privacy policies and practices of these sites.

Membership Conditions

Registration: Acrtech may condition the use of some sections on membership/registration, organize different membership categories, change existing categories. Some identity and contact information may be requested during registration.
Member name and password: A name and password are given to the Member or created by the member. The member is responsible for any; (i) identity information, (ii) contact information entered during registration, placed on the site and content, transmitted, or sent through this site. The identity and contact information provided for registration is considered current, accurate, and reliable. Keeping the username and password is the responsibility of the member. Acrtech does not accept any responsibility due to incorrect, unlawful, or unauthorized use of the username and password. In cases of unauthorized and unpermitted use, the member causing this is responsible for the damage and loss suffered by Acrtech or 3rd parties.

All responsibility for transactions made through the membership account belongs to the member. Members are deemed to have accepted and guaranteed that any information transmitted to the site or sent through this site is reliable, accurate, not misleading, does not violate the rights of 3rd parties, is not unlawful, is presented in good faith, and that they have the right to post or transmit the said information. The member is obliged to take necessary measures and notify Acrtech as soon as they learn that the username and password are used without permission or an attempt is made to capture them.

Commercial Communication

Members or users; have declared and accepted that electronic messages or commercial electronic messages may be sent from websites operated by Acrtech or 3rd parties that Acrtech does not own and does not control the operation of, and that they have given prior permission/consent for the sending of electronic messages to be sent via all kinds of electronic communication, whether of a commercial nature or not. The member has the right to cancel this permission/consent they have given at any time and reject commercial electronic messages. Rejection requests are processed by Acrtech within 3 business days at the latest. Rejection methods are shown in messages where the sender is Acrtech.

Collection of Visit Information

When the site is visited, web servers automatically start collecting information to ensure the site communicates with the visitor's computer. In addition, information such as the number of visits made to the site, which part of the site visitors prefer, IP addresses, domain type, browser type, date and time, and navigation on the website are monitored, audited, and stored. Using the site means that the user gives permission to Acrtech regarding the collection, processing, and storage of the specified information.

Personal Data

Personal data submitted/recorded by users to the site or collected automatically or via cookies by the Site in accordance with these Terms of Use will be subject to applicable law. This information can be used, processed, stored, shared with third parties in the country or abroad for these purposes, and used within the scope of advertising, marketing, notification, and similar activities related to Acrtech's field of activity for purposes such as providing access to the Site, member login, ensuring Site security, analyzing user habits, tastes and preferences, creating statistics, communication, marketing, making announcements, or for other purposes for which the Member's explicit consent is obtained, in accordance with the legislation and Personal Data Policy. In this context, Acrtech also has the right to benefit from site activity information, access tools, and browser information.

It is prohibited for users to collect, record, process personal data of other members and/or users through the Site or use, copy, reproduce the Site database. Users can access detailed information about Personal Data and their rights regarding the processing of their data from the Clarification Text and Personal Data Policy published on the site.

Prohibition of Interference

It is prohibited to violate or attempt to violate the security of the site. Legal and criminal proceedings may be applied and lawsuits may be filed against those who attempt such violations. Any violation claim will be investigated by Acrtech, and if illegal violation is suspected, relevant legal institutions will be applied to/cooperated with. If it is determined that the actions specified in this article have been carried out, the access of the relevant person and users to the site is terminated, and their memberships, if any, are cancelled. The person or persons committing the violation are financially, legally, and criminally responsible towards the person whose rights are violated and/or Acrtech in accordance with the laws.

Violation of Terms of Use

In case of non-compliance with the “Website Terms of Use” on the site or attempt to violate the rules, whether the violation is fully realized or not, Acrtech reserves the right (though not mandatory) to reject, remove from content, delete existing information in the system, suspend users' access to the site, terminate, cancel membership if any, without prior notice. It also applies to the case of indirect violation or attempted violation of the terms by a third party acting on behalf of the User. Acrtech's failure to use or apply any legal right or measure written here does not mean that Acrtech waives its rights specified in these Terms of Use or arising from the law or accepts the violation.

Site Policies

Criminal Acts: Users are obliged not to engage in any behavior that i) is a crime both internationally and under local legislation ii) is contrary to the relevant regulations and directives of the European Union.
Prohibited Behaviors: Users have accepted and undertaken not to run and use software that sends more messages to the site server than a human's sending capacity in a certain time period.

Termination

Unless there is an arrangement in a separate contract or site content, the user may terminate the use of the Site and membership, if any, at any time without being subject to any restriction and without giving notice. If foreseen on the site, it is mandatory to follow the steps regarding the termination of membership.

Acrtech also; may cancel membership, prevent use, or terminate without giving any notice (i) if the user violates the terms or policies written here or determined by Acrtech, (ii) if the user does not have the right to use due to legal restrictions, (iii) in accordance with the legislation or decisions of administrative regulatory institutions (iv) if the possibility of access to the site disappears due to legal regulations or force majeure, (v) due to suspension, stopping, termination of the site publication depending on Acrtech's discretion or similar reasons.

Records

In disputes that may arise from the use of the site, all kinds of electronic and commercial records, including Acrtech's books and communication logs, and e-mail, fax notifications made by Acrtech to users constitute definitive and exclusive evidence.

Language

If there is a discrepancy between the Turkish and foreign language versions of the Website, “Terms of use” and “Privacy and security terms”, the Turkish version is accepted as valid.

Notification Agreement

It has been accepted by Acrtech that e-mail or fax notifications to be made to the contact information of the users on the site will have the same legal consequences as valid notification.

Applicable Provisions

The Laws of the Republic of Turkey apply to disputes that may arise regarding the use of the site. Users residing outside the Republic of Turkey and connecting to the Site from outside the Republic of Turkey also accept that the laws of the Republic of Turkey are valid in disputes that may arise regarding the use of the site and waive their rights arising from all other applicable country regulations.

Competent Court and Enforcement Offices

Mersin Courts and Enforcement Offices will be authorized for the resolution of any disputes that may arise regarding the site and terms of use.
